Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the Brainwave Biohacking® application and related services (the “Service”) provided by Brainwave Biohacking® (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old and legally able to enter into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

You must provide accurate name and email information when creating an account. You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately of any unauthorized use.

You may cancel your subscription at any time from the account management portal linked in the app, or by contacting support. Cancellation stops future renewals. If you cancel during a trial, you will not be charged. If you cancel after a paid billing cycle, you retain access until the end of that cycle, and no further charges are made. We do not issue refunds for partial billing periods except where required by law.

Because every plan begins with a 3-day free trial, you can evaluate the Service fully before any charge occurs. If you cancel during the trial, you will never be charged. Once a paid billing cycle begins, all charges are non-refundable except where required by applicable law. You retain access through the end of any paid cycle you have already been charged for. You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Share, resell, or sublicense your account or access to the Service to third parties.
• Attempt to reverse engineer, decompile, or otherwise extract source code or proprietary audio content from the Service.
• Abuse the AI Coach or guided meditation features, including automated or bulk generation that circumvents usage caps.
• Interfere with or disrupt the Service or servers hosting it.

The AI Coach responses and guided meditation scripts are generated by automated models and may be incomplete, inaccurate, or unsuitable for your situation. They are provided for informational and motivational purposes only. You are responsible for evaluating any AI-generated content before relying on it.

All content in the Service, including entrainment audio, brainwave protocols, branding, and software, is owned by or licensed to Brainwave Biohacking® and protected by intellectual property laws. You receive a personal, non-exclusive, non-transferable license to use the Service for the duration of your subscription. You may not copy, distribute, or create derivative works from the Service except as expressly permitted.

The Service is a wellness, productivity, and relaxation tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Do not use the Service as a substitute for professional medical care. Consult a licensed physician for sleep, neurological, or mental health conditions. Do not use entrainment audio while driving or operating machinery.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that it will produce any specific result.

To the fullest extent permitted by law, Brainwave Biohacking® and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Brainwave Biohacking® from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

We may suspend or terminate your account if you violate these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends immediately. Sections regarding intellectual property, disclaimers, and limitation of liability survive termination.

We may revise these Terms from time to time. Material changes will be posted in the app and, where appropriate, emailed to you. Continued use after changes constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the jurisdiction in which Brainwave Biohacking® is established, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of its courts for any dispute arising from these Terms.
